Terms of service

1. general and business relations

  1. The following General Terms and Conditions apply to the contractual relationships between the seller and its customers (hereinafter referred to as "buyer") concluded within the framework of the online store of Görges Naturprodukte GmbH, represented by the managing director Mark Gnotke, Weihersfeld 42, 41379 Brüggen (hereinafter referred to as "seller").
  2. Contracts are concluded with both consumers and entrepreneurs.
  3. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside his trade, business or profession
  4. According to § 14 BGB, an entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, is acting in exercise of their trade, business or profession. A partnership with legal capacity is a partnership that has the capacity to acquire rights and enter into obligations.

2 Conclusion of the contract

  1. All products, articles and services to be purchased in the seller's online store do not constitute binding offers by the seller in the legal sense, but are in turn an invitation to the buyer to make an offer.
  2. Once the order has been sent by the buyer, the buyer shall immediately receive an e-mail confirming receipt of the order, but this does not yet constitute acceptance of the offer in the legal sense, whereby the contract is concluded. The contract is concluded by a separate order confirmation from the seller. Alternatively, the contract is concluded when the ordered goods are delivered to the customer or the customer is requested to make payment.

3 Prices, value added tax, payment

  1. All prices quoted are total prices including statutory VAT plus any shipping costs incurred depending on the delivery method (see § 4).
  2. The seller offers those payment methods that are communicated within the online store. The seller issues the customer with an invoice for the ordered goods, which is enclosed with the delivery of the goods or sent by letter.

4 Deliveries, shipping costs and transfer of risk

  1. If a delivery (delivery to the shipping company) has been agreed between the seller and the buyer, this shall take place immediately after receipt of payment. The shipping and packaging costs and the delivery date can be found in the respective item description. The shipping and packaging costs for the respective countries to which the corresponding items are shipped are shown there as a precise total amount.
  2. If the buyer is a consumer within the meaning of § 13 BGB, the risk of accidental loss and accidental deterioration of the goods sold shall not pass until the goods are handed over to the customer or a person authorized to receive them. If the customer commissions the forwarding agent or the person or institution otherwise designated to carry out the shipment and the seller has not previously named this person or institution to the customer, the risk of accidental loss and accidental deterioration of the goods sold shall pass to the customer, even in the case of consumers, as soon as the seller has delivered the goods to the forwarding agent or the person or institution otherwise designated to carry out the shipment
  3. However, if the buyer is an entrepreneur, the risk shall pass to the buyer as soon as the seller has delivered the goods to the carrier or other person or institution designated to carry out the shipment.
  4. The seller's terms of delivery and payment are specified in the order form. Please refer to the respective item description for the delivery date.
  5. On the last order page before submitting your offer, you will again receive a complete overview of the essential characteristics of the goods, the total price of the goods, as well as all associated components such as shipping and packaging costs.

5. revocation instruction

Right of withdrawal

You have the right to cancel this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods.

To exercise the right to cancel, you must inform us (Görges Naturprodukte GmbH, represented by the managing director Mark Gnotke, Weihersfeld 42, 41379 Brüggen, phone: 02163 5725080, service@aniforte.de) of your decision to cancel this contract by a clear statement (e.g. a letter sent by post or e-mail). You can use the attached sample withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest. You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You must bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

Exclusion of the right of withdrawal

The right of withdrawal does not apply to contracts

  • for the delivery of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
  • for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded.
  • for the supply of alcoholic beverages, the price of which was agreed upon conclusion of the contract, but which can be delivered at the earliest 30 days after conclusion of the contract and the current value of which depends on fluctuations in the market over which the trader has no influence.
  • for the supply of newspapers, periodicals or magazines with the exception of subscription contracts.
  • for the supply of goods whose price depends on fluctuations in the financial market over which the trader has no control and which may occur within the withdrawal period.

The right of withdrawal may lapse for contracts

  • for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
  • for the delivery of goods if they have been inseparably mixed with other goods after delivery due to their nature.
  • for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.

10. information obligation according to the Battery Act (BattG)

In connection with the sale of batteries or accumulators or with the delivery of devices containing batteries or accumulators, we are obliged to point out the following in accordance with the Battery Ordinance: Batteries must not be disposed of with household waste. As the end user, you are legally obliged to return used batteries. You can return batteries free of charge after use at the point of sale or in the immediate vicinity (e.g. at municipal collection points or in shops). You can also return batteries from our range in normal quantities to us by post. Batteries or accumulators that contain harmful substances are marked with the symbol of a crossed-out dustbin. The chemical name of the harmful substance is next to the dustbin symbol. "Cd" stands for cadmium, "Pb" for lead, "Hg" for mercury, "Li" for lithium, "Ni" for nickel, "Mh" for metal hydride and "Zi" for zinc. The symbols under the waste garbage cans stand for:
Pb: Battery contains more than 0.004% lead by mass
Cd: Battery contains more than 0.002 percent cadmium by mass
Hg: Battery contains more than 0.0005 percent mercury by mass

The crossed-out wheeled garbage can symbol means that the battery must not be disposed of with household waste.

Further detailed information on the Battery Act can also be obtained from the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety.

11th Act on the Placing on the Market, Return and Environmentally Sound Disposal of Electrical and Electronic Equipment

Since August 13, 2005, manufacturers have been obliged to take back old electrical and electronic equipment placed on the market free of charge. Manufacturers must mark their electrical and electronic equipment placed on the market after November 23, 2005 with a symbol (crossed-out wheeled garbage can). As a retailer, we are legally obliged to inform you that such old appliances must not be disposed of as unsorted municipal waste, but must be collected separately and disposed of via the local collection and return systems. In accordance with the "ElektroG" law of March 23, 2005, as of November 25, 2005, we will only sell electrical and electronic equipment from manufacturers who have registered accordingly with the competent authority and can provide evidence of an insolvency-proof guarantee for the financing of the return and disposal of their electrical equipment.

12. final provision

The contractual relationship between the seller and the customer as well as the respective terms and conditions shall be governed by the law of the Federal Republic of Germany. Consumers whose habitual residence is abroad may also invoke the law of the country in which they are domiciled, irrespective of the specific choice of law.
